    Welcome to FOODTEN.com (“Site”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of FOODTEN.com, including any content, functionality, and services offered on or through the Site.

    By accessing or using our Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Site.

    We reserve the right to modify these Terms at any time. All changes are effective immediately when posted on this page and apply to all access to and use of the Site thereafter. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

    You must be at least 13 years of age to use our Site. By using our Site, you represent and warrant that you meet the eligibility requirements. If you do not meet these requirements, you must not access or use the Site.

    We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site for personal, non-commercial purposes. This license does not include:

    • Modifying, preparing derivative works, distributing, publicly performing or displaying the Site or its content
    • Using any data mining, robots, or similar data gathering or extraction methods
    • Using the Site or its content for any commercial purpose
    • Removing any copyright, trademark, or other proprietary notices
    • Transferring the materials to another person or “mirroring” the materials on any other server

    5.3 Trademark Usage

    Our name, the term “FOODTEN,” our slogan “One Dish, Ten Ways. Endless Inspiration,” and all related names, logos, product and service names, designs, and slogans are trademarks of FOODTEN.com or its affiliates. You must not use such marks without our prior written permission.

    6. User Content

    6.1 User Contributions

    The Site may contain message boards, forums, personal web pages or profiles, recipe submissions, ratings, reviews, and other interactive features (collectively, “Interactive Services”) that allow users to post, submit, publish, display, or transmit content to other users or the public (collectively, “User Content”).

    6.2 Content Standards

    All User Content must comply with these Terms and must not:

    • Be defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable
    • Promote sexually explicit or pornographic material, violence, or discrimination
    • Infringe any patent, trademark, trade secret, copyright, or other intellectual property rights
    • Violate the legal rights of others or contain any material that could give rise to civil or criminal liability
    • Be false, misleading, or deceptive
    • Promote illegal activity or advocate, promote, or assist any unlawful act
    • Cause annoyance, inconvenience, or needless anxiety or be likely to upset, embarrass, alarm, or annoy any other person
    • Impersonate any person, or misrepresent your identity or affiliation with any person or organization
    • Involve commercial activities or sales without our prior written consent

    6.3 License to User Content

    By posting User Content on the Site, you grant us and our affiliates a perpetual, worldwide, non-exclusive, royalty-free, transferable, and sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media formats and through any media channels.

    6.4 Recipe Submissions

    When you submit a recipe to our Site:

    • You affirm that you are the creator of the recipe or have the necessary rights to share it
    • You understand that the recipe will be published on the Site along with your username
    • You grant us the rights described in section 6.3 above to use your recipe
    • You acknowledge that we may make modifications to improve clarity, consistency, or format

    6.5 Responsibility for User Content

    You are solely responsible for your User Content. We are not responsible for the accuracy, completeness, appropriateness, or legality of User Content. We do not endorse any User Content and have no obligation to monitor User Content. However, we reserve the right to:

    • Remove or refuse to post any User Content for any reason
    • Take any action with respect to User Content that we deem necessary or appropriate
    • Disclose information to law enforcement authorities or comply with legal processes

    7. Prohibited Uses

    You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

    • In any way that violates any applicable federal, state, local, or international law or regulation
    • To exploit or harm minors in any way
    • To send, knowingly receive, upload, download, use, or re-use any material which does not comply with the Content Standards set out in these Terms

    Additionally, you agree not to:

    • Use any robot, spider, or other automatic device, process, or means to access the Site for any purpose
    • Use any manual process to monitor or copy any of the material on the Site
    • Use any device, software, or routine that interferes with the proper working of the Site
    • Introduce any viruses, trojan horses, worms, logic bombs, or other harmful material
    • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site

    9.1 Third-Party Content

    The Site may contain content provided by third parties, including other users, bloggers, third-party licensors, syndicators, or aggregators. We are not responsible for the content or statements provided by third parties on or through the Site.

    The Site may contain links to third-party websites or services that are not owned or controlled by FOODTEN.com. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.     10. Disclaimer of Warranties

    10.1 Site Content

    THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER FOODTEN.COM NOR ANY PERSON ASSOCIATED WITH FOODTEN.COM MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE.

    10.2 Food Safety and Nutrition Information

    While we strive to provide accurate recipe information, we do not guarantee:

    • The accuracy of cooking times, temperatures, or methods
    • The nutritional information provided with recipes
    • The suitability of recipes for individuals with food allergies, intolerances, or dietary restrictions

    10.3 Disclaimer of Specific Warranties

    WITHOUT LIMITING THE FOREGOING, NEITHER FOODTEN.COM NOR ANYONE ASSOCIATED WITH FOODTEN.COM REPRESENTS OR WARRANTS THAT THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED; THAT DEFECTS WILL BE CORRECTED; THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR THAT THE SITE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

    12. Indemnification

    You agree to defend, indemnify, and hold harmless FOODTEN.com, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, your User Content, any use of the Site’s content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Site.

    13. Geographic Restrictions

    The owner of the Site is based in the United States. We provide this Site for use only by persons located in the United States. We make no claims that the Site or any of its content is accessible or appropriate outside of the United States. Access to the Site may not be legal by certain persons or in certain countries. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

    14. Governing Law and Jurisdiction

    All matters relating to the Site and these Terms, and any dispute or claim arising therefrom or related thereto, shall be governed by and construed in accordance with the internal laws of the United States without giving effect to any choice or conflict of law provision or rule.

    Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal courts of the United States. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

    15. Arbitration

    15.1 Disputes

    Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration, using the English language, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect.

    15.2 Arbitration Location and Procedure

    The arbitration will be conducted online and the arbitrator will use all reasonable efforts to complete the arbitration within 90 days of the filing of the dispute.

    15.3 Arbitrator’s Powers

    The arbitrator may not make any award that is not consistent with these Terms or provide any remedy that would otherwise be prohibited by these Terms. The arbitrator shall have exclusive authority to resolve all disputes arising out of or relating to the interpretation, applicability, enforceability, or formation of these Terms, including, but not limited to, any claim that all or any part of these Terms is void or voidable.

    15.4 No Class Actions

    YOU AND FOODTEN.COM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

    16. Waiver and Severability

    No waiver by FOODTEN.com of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of FOODTEN.com to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

    If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

    17. Entire Agreement

    The Terms constitute the sole and entire agreement between you and FOODTEN.com regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.

    18. Termination

    We may terminate or suspend your account and bar access to the Site immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

    All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

    19. Changes to the Site

    We reserve the right to withdraw or amend the Site, and any service or material we provide on the Site, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Site is unavailable at any time or for any period.
